These Terms of Service govern your use of the website at www.newhoperealty.lol and the resale flat services provided by New Hope Properties Limited from its shopfront at Rm 2 4/F Liven House, 61-63 King Yip St, Kwun Tong, Hong Kong - 999077, Hong Kong (HK). By using the website or asking the shopfront to act for you, you agree to these terms. If you do not agree, please do not use the services. Questions about the terms may be sent to portal@newhoperealty.lol or asked by telephone on +14849317995.
The Company provides a practical shopfront service: it prepares flat sheets, arranges viewing slot runs, drafts offer letters, makes mortgage referrals on request, reviews rent rolls and conducts handover key sittings. It does not act as a solicitor, a licensed surveyor, a financial adviser or a lender, and nothing in these terms creates such a relationship.
These terms take effect when you first use the website or when you ask the Company to provide a service, whichever happens first. If you act on behalf of a company or another person, you confirm that you have authority to accept these terms on that entity or person behalf. If you do not have that authority, you must not use the services in that capacity.
These terms apply in addition to any written agreement you sign with the Company for a particular transaction. Where a specific written agreement conflicts with these terms, the specific agreement prevails for that transaction, and the remaining parts of these terms continue to apply.
The Company runs six desks at the Kwun Tong shopfront: Flat Sheet Bays, Viewing Slot Runs, Offer Letter Desks, Mortgage Referral Windows, Rent Roll Reviews and Handover Key Sittings. The services page describes each desk in detail. The description on the website is a summary and does not promise a specific outcome for any particular flat or buyer.
The Company may add, change or withdraw a service from time to time. Where a change affects a service you have already requested, the Company will honour the arrangement already agreed for that request unless it is prevented from doing so by law or by events beyond its control.
Each service is delivered at the shopfront at Rm 2 4/F Liven House, 61-63 King Yip St, Kwun Tong, Hong Kong - 999077, Hong Kong (HK), and the paper records that support it are kept there. A service that is described as an introduction, such as the mortgage referral window, ends when the introduction has been made. A service that is described as a review, such as the rent roll review, ends when the written summary has been handed over. Understanding where a service begins and ends matters, because the obligations in these terms attach to the service as it is described and not to the wider property transaction.
Where a buyer or a seller wants a service that the Company does not offer, the desk will say so plainly rather than attempt work outside its competence. The Company does not prepare formal valuations, does not certify title and does not provide legal or tax advice. If your needs fall outside the six desks, the desk will suggest the kind of professional who can help, though the choice of that professional remains yours.
You may use the website for lawful purposes connected with buying, selling or renting a flat. You must not use the website to send unlawful, misleading or abusive material, to attempt to gain access to systems you are not authorised to use, to interfere with the operation of the site, or to scrape content at a volume that degrades the service for others.
The contact form is provided so that you can reach the shopfront. Messages sent through the form may be delivered by email, and ordinary email is not a fully secure channel. Please do not send passwords, bank details or sensitive documents through the form. For such material, contact the desk first so that a safer method can be agreed.
The website is provided as it stands. The Company works to keep it available and correct, but it cannot promise uninterrupted access, and it may take the site down briefly for maintenance. Where a page contains an error, the error does not create an obligation to provide a service on those terms, and the desk will confirm the correct position before any work begins.
You may print pages for your own reference. You may not frame the site inside another website, mirror its content on another domain, or present its pages as part of a different business. Automated access is permitted only at a modest rate that does not burden the server, and the Company may block an address that ignores this limit.
A flat sheet is a record prepared from an inspection of a resale unit. It describes the unit as observed on the date of inspection, and it is intended to help a buyer decide whether to arrange a viewing. The sheet is not a survey, a valuation or a legal description, and it does not replace an inspection by a qualified professional.
The Company aims to record each unit honestly, including features that a buyer might otherwise discover only after purchase. Even so, conditions can change between inspection and viewing, and the Company cannot guarantee that every detail on the sheet will still be accurate at a later date. If you notice a discrepancy, tell the desk and the sheet will be corrected and dated.
A viewing slot run is an arranged route through one or more flats at agreed times. The Company will confirm the slot, notify building management as required, and accompany you on the walk where the arrangement includes accompaniment. You must arrive on time and follow the reasonable instructions of the person conducting the walk.
You are responsible for your own safety on the premises and for the conduct of any guest you bring. You must not take photographs, open cupboards or remove items without permission, and you must leave the flat in the condition in which you found it. If a viewing cannot proceed because a seller withdraws or a building refuses access, the Company will tell you promptly and offer an alternative slot or a full cancellation of that slot.
The Company will draft an offer letter based on the instructions you give at the desk. You are responsible for checking that the letter accurately reflects your intentions before you sign it. The Company will read the letter back to you and will make any correction you request before signature.
An offer letter is not a contract for the sale of land. It records a proposal, and it becomes binding only if and when the parties enter into a binding agreement, normally with the assistance of their own solicitors. The Company does not guarantee that a seller will accept an offer, that a transaction will complete, or that a figure proposed at the desk is achievable in the market.
The mortgage referral window is an introduction service. The Company will pass your contact details to one or more lending partners at your request, and will explain that the referral is separate from the loan itself. The Company does not lend money, does not set lending terms and does not decide whether an application will be approved.
Any agreement you reach with a lending partner is between you and that partner. You should read the lender terms and the loan documentation before signing. The Company is not responsible for the conduct of a lending partner, although it will stop making referrals to a partner if it has reasonable grounds to believe the partner is acting improperly.
A rent roll review summarises the lease of a tenanted flat for the benefit of a prospective buyer. It is prepared from the documents provided by the seller or the seller agent, and from the Company own inspection where an inspection has been carried out. The review is a summary and not a legal opinion, and it does not replace advice from a solicitor.
The Company will flag clauses that appear to affect a buyer, such as break options or rent review mechanisms, but it cannot guarantee that every relevant clause has been identified. A buyer should have the full lease reviewed by a qualified adviser before committing to a purchase.
A handover key sitting is a meeting at which keys are counted against a schedule, locks are tested and meter readings are recorded. Both parties sign the handover sheet. The Company facilitates the meeting and keeps a copy of the sheet, but it does not warrant that the flat is in any particular condition beyond what the sheet records.
If a party fails to attend a sitting, the Company will reschedule where possible and will charge any reasonable additional cost of the rearrangement under the fees section below. The Company will not release keys to a person who cannot show authority to receive them.
The Company charges fees for the services it provides, and the applicable fee will be explained before a service is confirmed. The mortgage referral window is free to buyers. Where a fee is payable, the Company will state the amount, what it covers and when it falls due. No fee is charged without your prior agreement.
Unless a written agreement says otherwise, fees are payable on the day a service is provided. Amounts that remain unpaid may be pursued through the ordinary legal process. If you believe a fee has been charged in error, tell the desk promptly and the Company will review the matter before taking any further step to collect.
You agree to give accurate information when you ask for a service, to tell the Company promptly if your contact details change, and to keep confidential any material the Company marks as confidential. You agree not to use the services for any unlawful purpose and not to misrepresent your identity or your authority to act for another person.
If you instruct the Company on behalf of a seller, you confirm that you are authorised to share the documents the Company needs, including the lease and the key schedule. If you instruct the Company on behalf of a buyer, you confirm that the buyer knows you are acting and agrees to the information being shared with the desk.
The Company takes care to keep the flat sheets, rent roll reviews and other records accurate. Even so, the information is provided as it stands, and the Company does not warrant that it is complete or free from error. Measurements can vary with the method used, and descriptions of condition reflect the view of the inspector at a single moment.
Where a figure on a sheet is important to your decision, verify it independently or ask the desk to check it again. The Company will cooperate with a reasonable verification request, but it cannot accept responsibility for a decision taken solely on the basis of a summary.
To the extent permitted by law, the Company is not liable for indirect or consequential loss, for loss of profit or opportunity, or for loss arising from a transaction that does not complete. The Company is not liable for the acts or omissions of a seller, a buyer, a solicitor, a lender, a building manager or any other third party.
Where liability cannot lawfully be excluded, the liability of the Company is limited to the fee paid for the service that gave rise to the claim. Nothing in these terms excludes liability for fraud, for death or personal injury caused by negligence, or for any other liability that the law does not allow to be excluded.
You agree to indemnify the Company against any loss, claim or expense that arises from your breach of these terms, from information you provide that is false or misleading, or from your misuse of the website. This indemnity does not apply to the extent that the loss is caused by the Company own negligence or breach of these terms.
The content of the website, including its text, layout, drawings and code, belongs to the Company or is used with permission. You may read, print and share the flat sheets and other materials the Company gives you for the purpose of a property transaction, but you may not reproduce them for commercial use without written permission.
The name New Hope Properties Limited and the shopfront identity are protected marks. Nothing in these terms grants you a licence to use them except as necessary to refer to the Company in the ordinary course of a transaction.
The website may link to websites run by other organisations. Those sites are not under the control of the Company, and the Company is not responsible for their content or their privacy practices. A link does not imply endorsement, and you should read the terms of any site you visit.
Where a service depends on a third party, such as a bank or a building management office, the timing and quality of that third party work is outside the control of the Company. The Company will make reasonable efforts to keep a transaction moving, but it cannot guarantee the speed of a third party.
The Company may suspend or end your access to the website if you breach these terms, if required by law, or if continuing would put other users at risk. Where a service has already been paid for, the Company will account for the value of work not yet performed.
You may stop using the services at any time. Ending the relationship does not affect the rights and obligations that have already arisen, including the obligation to pay a fee that has fallen due and the retention of records described in the privacy policy.
The Company is not liable for a delay or failure caused by an event beyond its reasonable control, such as severe weather, a building closure, a power failure, a postal disruption or a change in the law. Where such an event occurs, the Company will tell you promptly and will reschedule the affected service as soon as it is practical to do so.
These terms are governed by the law of the Hong Kong Special Administrative Region. The courts of Hong Kong have jurisdiction over any dispute arising from these terms, although the Company will always try to resolve a concern at the desk before any formal step is taken.
If you have a complaint, write to the shopfront at Rm 2 4/F Liven House, 61-63 King Yip St, Kwun Tong, Hong Kong - 999077, Hong Kong (HK) with a short description of the issue and the outcome you are seeking. The Company will acknowledge the complaint and respond within a reasonable period.
The Company may update these terms from time to time. The date at the top of the page shows when the current version took effect. Where a change materially affects an ongoing service, the Company will give reasonable notice before the change applies to that service.
If any part of these terms is found to be invalid, the remaining parts continue in force. A failure to enforce a provision on one occasion does not waive the right to enforce it on another.
